Article 123: Rights of Owners

A mining right does not extinguish a property right. No right to prospect or operate is valid without the consent of the landowner or its successors, with regard to activities involving the surface or affecting it.

The rights of owners, usufructuaries and occupants of the land as well as those of their successors are not affected by the granting of Mining Titles and Authorisations beyond that which is provided in this Title.

The holder of the Mining Title or Authorisation may occupy, within the area of such Title or Authorisation, the land required for its activities, if it is so authorised by its Title or Authorisation or by order of the Minister.
