Property rights shall be exercised throughout the term of the operation through the collection of compensation.
The holder of the Mining Title or Authorisation must pay any lawful occupant of land required for its activities, compensation for the disturbance of enjoyment suffered by such occupants.
The amount, frequency, method of payment and all other terms relating to the above-mentioned compensation are determined in accordance with the provisions of this Code and its implementing regulations. The amount of the compensation must be reasonable enough in order not to compromise the viability of the project, and proportional to the disturbance caused by Mining Activities, in accordance with the procedures set out in the Act.
