Article 8: Conflicts of Interest

Members of Government, civil servants within the Ministry in charge of Mines and Geology and other civil servants involved in the management of the mining sector, may not have a direct or indirect financial interest in mining companies or their direct or indirect subcontractors.

Under pain of sanction, they are required to declare their interests and/or to declare themselves incompetent to participate in taking any decision with a direct or indirect impact on their interests.

In the same vein and under pain of sanction, executives and agents of mining companies may not hold a direct or indirect financial interest in companies with a direct or indirect subcontract with the company that employs them, and/or other companies with any financial interest whatsoever with the companies for which they work as employees

Any subsidiary of the titleholder or of one of its shareholders must file a prior declaration of identity specifying the nature of the relationship in any tender with an economic and financial stake regarding mining companies in Guinea.
