No individual or legal entity, including owners of land or surface rights, may carry out any of the activities listed in Article 6 above in the territory of the Republic of Guinea or its exclusive economic Zone, without observing the provisions of this Code and its implementing regulations.
Total or partial refusal by the State to grant a Mining Title or Authorisation does not entitle the unsuccessful applicant to any form of indemnification whose application does not meet the requirements of this Code.
No legal entity may obtain a Mining Operation Title Permit or Mining operation permit for Quarry Substances, if it is not established in accordance with the uniform act of OHADA relating to Commercial Companies and Economic Interest Group.
