The holder of a Mining Title or Authorisation must observe the highest standards of health and safety as established by the Minister in charge of Mines in collaboration with the Minister in charge of Public Health, the Minister in charge of Labour, and the Minister in charge of Environment.
Where these standards are lower than the standards observed elsewhere by the holder, the latter shall prevail. In this respect, the holder must draft and implement regulations in accordance with such standards to ensure the health and safety of workers under optimal conditions.
The text of such regulations is submitted for prior approval to the National Mining Authority after approval by the competent technical departments. Once approved, copies of the regulations are posted in the most visible locations for workers on operation and work sites.
When part of the work in a mine or quarry is given to a contractor or subcontractor, the latter is obliged to respect all such regulations under this Article.
