Article 213: Violation of Bribery Provisions of this Code

A breach of the provisions of this Code regarding the prohibition of companies from paying Bribes constitutes an act of active corruption or influence peddling, respectively defined in Articles 194 and 195 of the Criminal Code and will be punish by fines and imprisonment provided by the said Criminal Code.

Any legal entity convicted of a Bribe will be liable for a civil fine of up to five percent (5%) of its turnover for the year preceding the judgment, or five percent (5%) of its turnover for the year in which the offense was committed, or forup to the amount of the damage caused by the offence, whichever is highest. This fine will apply notwithstanding the application of any other fine provided by the Criminal Code.
