All holders of Mining Title or Authorisations as well as companies working on their behalf are required to prepare and submit for the approval of the National Office for Training and Professional Development (l’OfficeNational de la Formation et du Perfectionnement Professionnel), or any department acting on its behalf, a training and development program that encourages to the greatest extent the transfer of technology and skills to Guinean businesses and staff; and a Guineanization program in accordance with the minimum quotas set out in the previous Article.
The training and development plan must, include, in particular:
the acceptance of graduates from professional schools and universities for professional training internships of a period of six (6) months and business training internships for students in initial training for a period of two (2) months;
the participation of Guinean employees in courses and/or training seminars, organized in the Republic of Guinea or abroad.
The Agence Guinéenne pour la Promotion de l’Emploi (AGUIPE) or any department acting on its behalf, may request the investor to supplement the training of Guinean employees through their participation in operations conducted abroad to give them expertise in the various sectors of mining.
The holders of Mining Title or Authorisations and the companies working on their behalf must establish a career and progression plan for all employees, notably for those in supervisory and management roles, or for any position requiring particular expertise in compliance with the minimum quotas set out in the previous Article.
Expatriate employees of holders of Mining Title Permits or Authorisations and those of companies working on their behalf must have a work permit that sets out in advance the number of years during which they must remain with the company. This period must correspond with the initial period stipulated by the law regarding the entry and residence of foreigners in the Republic of Guinea and the Labor Code. It is renewable only once.
